MyCommonSpirit - Mountain Terms and Conditions of Use

MyCommonSpirit - Mountain is an online service offered by CommonSpirit Health Mountain Region to allow you online access to your personal medical information and the ability to communicate online with your health care providers. By accessing or using MyCommonSpirit - Mountain, you confirm that you have fully read, understand and agree to MyCommonSpirit - Mountain Terms and Conditions of Use, including but not limited to, the additional terms and conditions specific to such services as E-Visit and Video Visit ("Terms of Use"). If you do not agree to the Terms of Use, you will not be permitted to use MyCommonSpirit - Mountain. Throughout the Terms of Use, CommonSpirit Mountain Region is referred to as "MyCommonSpirit - Mountain", "We", “Our” or "Us". Individuals accessing or using MyCommonSpirit - Mountain are referred to as "You", "Your", or "User(s)".

Purpose of MyCommonSpirit - Mountain

MyCommonSpirit - Mountain allows you another option to access your medical information and communicate with your health care providers. MyCommonSpirit - Mountain allows you to view certain medical information online in a secure manner, including, but not limited to, selected portions of your medical record and summary health information, current medications, allergies, immunizations, histories, and test results. MyCommonSpirit - Mountain also provides a method to communicate with certain health care providers to allow you to: (1) receive important health reminders, (2) request prescription refills and renewals, and (3) communicate with your health care providers about non-urgent medical issues.

MyCommonSpirit - Mountain is not intended to be used to address medical emergencies. IF YOU ARE EXPERIENCING AN EMERGENCY OR URGENT MEDICAL PROBLEM, GO TO THE NEAREST EMERGENCY ROOM OR CALL 9-1-1 OR YOUR PHYSICIAN'S OFFICE IMMEDIATELY.

Your Account Profile, User ID and Password

Prior to your initial log into MyCommonSpirit - Mountain, you must review these Terms of Use and create a personal profile account. You may only provide information that you own or have the right to use when you create, transmit, or display health or any other information while using MyCommonSpirit - Mountain. You represent and warrant that all information you provide or supply to CommonSpirit Health through MyCommonSpirit - Mountain, including without limitation, information contained in your personal profile, is accurate and complete. You are responsible for maintaining the confidentiality of all user identification, password and other confidential information relating to the use of your account and are fully responsible for all activities that occur under your account. You are responsible for taking all reasonable steps to ensure that no unauthorized person accesses your account. You must promptly notify CommonSpirit Health of any unauthorized use of or access to your MyCommonSpirit - Mountain account. CommonSpirit Health assumes no responsibility or liability for any information that you transmit, receive from or submit to MyCommonSpirit - Mountain, or for any use or misuse by you or third parties who you authorize.

Medical Records

You may have the opportunity to access healthcare records and information through MyCommonSpirit - Mountain ("Your Records"). You hereby grant CommonSpirit Health, its employees, officers, directors, agents and contractors, and all other persons or entities involved in the operation of MyCommonSpirit - Mountain, the right to access, transmit, receive, monitor, retrieve, store, maintain and use your Records in accordance with CommonSpirit Health's Notice of Privacy Practices. You are responsible for reviewing your account information as well as any documents produced by MyCommonSpirit - Mountain.

Minor Eligibility

An individual must be 18 years of age or older to request a MyCommonSpirit - Mountain account. With parental or legal guardian written consent and an individual email address for the minor, children between the ages of 13 and 17 (inclusive) will be able to access MyCommonSpirit - Mountain.

Parents or legal guardians of minor children up to age 12 may request access to their minor child’s medical information through MyCommonSpirit - Mountain. See the “Proxy Access” section below for further details.

Under state law, there are certain types of medical information that a parent or legal guardian of a minor may not view without consent of the minor. Therefore, once a minor reaches age 13, restrictions will be placed on MyCommonSpirit - Mountain access until he/she reaches 18 or until consent for the minor to have a MyCommonSpirit - Mountain account has been signed by a parent or legal guardian and the minor activates his/her own account.

Parents and legal guardians will always have the right to request copies of complete medical records for their children, as permitted by law.

Proxy Access

Individuals 18 years of age or older (or minors between the ages of 13 and 17 in certain circ*mstances as described below) may grant friends and family proxy access to their MyCommonSpirit - Mountain account at any time. You control who can have proxy access to your MyCommonSpirit - Mountain account and once you grant access to someone else it becomes your responsibility. If you authorize someone else to have proxy access to your MyCommonSpirit - Mountain account who is not legally required to keep it private, your health information may be re-disclosed by that individual and may no longer be protected.

Proxy access can be given by logging in to MyCommonSpirit - Mountain, selecting “Share My Record” from the main menu, and entering the name and email address of the person who you would like to grant access. A MyCommonSpirit - Mountain account must be activated for both the proxy and the account holder. All medical information that is made available in MyCommonSpirit - Mountain will also be made available to your proxy.

Minor children between the ages of 13 and 17 (inclusive) may grant a parent or legal guardian proxy access to their MyCommonSpirit - Mountain account once they have written consent by a parent or legal guardian to have their own MyCommonSpirit - Mountain account.

A minor who allows a parent or legal guardian to access the minor's account is permitting the parent/guardian access to information that may be confidential under State and Federal law. A minor who allows the parent or legal guardian to access the minor's account is voluntarily disclosing such confidential information to the minor's parent or legal guardian and CommonSpirit Health shall not be liable for any breach of confidential information in such circ*mstance.

Parents or legal guardians of minor children up to age 12 may request proxy access to their child’s MyCommonSpirit - Mountain account by completing a Proxy Access Authorization Form and submitting it to us. Such access will only be granted to parties with parental rights or legal guardianship over the MyCommonSpirit - Mountain account holder and only to the extent the party requesting proxy access can demonstrate their legal right to the account holder's medical information.

Proxy access can be revoked at any time by the account holder by logging into MyCommonSpirit - Mountain, navigating to “Friends and Family Access” and selecting “Revoke.” CommonSpirit Health reserves the right to revoke proxy access at any time for any reason.

Communication

If you elect to use MyCommonSpirit - Mountain, it may be used by your health care providers to communicate selected test results and other important medical information to you. If you opt in, you may also receive SMS messages regarding activity in connection with your MyCommonSpirit - Mountain Account (see Additional Terms and Conditions: SMS Messaging Services below for more details). CommonSpirit Health assumes no responsibility for how you use the information you obtain from MyCommonSpirit - Mountain. You should direct any questions you have about the data available to you in MyCommonSpirit - Mountain to your physician or other healthcare provider.

You should not use MyCommonSpirit - Mountain to send messages regarding matters requiring urgent attention. While reasonable efforts will be made to provide a timely response to communications through MyCommonSpirit - Mountain, CommonSpirit Health cannot guarantee a specific time frame for a response or that any response will be provided. Delays can occur based on the volume of messages and technology outside of CommonSpirit Health's control. At times, the clinic staff or personnel needed to respond to your message may not be available, so you should allow at least two (2) business days for any response. For these reasons, you should not use MyCommonSpirit - Mountain to communicate with CommonSpirit Health or your healthcare provider in urgent situations. For all urgent medical matters, contact your physician's office directly, or go directly to an emergency room or call 911.

CommonSpirit Health is only able to respond to electronic communications based on the information you provide. If you provide insufficient information, CommonSpirit Health will be unable to provide an accurate or reliable response.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT COMMONSPIRIT HEALTH SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR INJURY, ILLNESS, DISABILITY, LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF COMMONSPIRIT HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) YOUR USE OR YOUR INABILITY TO USE MYCOMMONSPIRIT - MOUNTAIN; (ii) THE COST OF PROCUREMENT OF SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON MYCOMMONSPIRIT - MOUNTAIN; (v) YOUR USE OF THE INTERNET OR YOUR INTERNET SERVICE PROVIDER; (vi) DEFECTS OR INACCURACIES IN YOUR COMPUTER HARDWARE OR SOFTARE, OR ANY OTHER DEVICE USED TO ACCESS MYCOMMONSPIRIT - MOUNTAIN OR THE SERVICES; OR (vii) ANY OTHER MATTER RELATING TO YOUR USE OF MYCOMMONSPIRIT - MOUNTAIN. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF COMMONSPIRIT HEALTH EXCEED THE TOTAL AMOUNT OF FEES PREVIOUSLY PAID BY YOU TO COMMONSPIRIT HEALTH RELATING TO THE YOUR USE OF MYCOMMONSPIRIT - MOUNTAIN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

ANY INFORMATION CONTAINED ON MYCOMMONSPIRIT - MOUNTAIN OR PROVIDED THROUGH MYCOMMONSPIRIT - MOUNTAIN IS PROVIDED ON AN "AS IS" BASIS ONLY AND IT IS NOT INTENDED, OR TO BE CONSTRUED, AS MEDICAL ADVICE, DIAGNOSIS AND TREATMENT, AND IS NOT A SUBSTITUTE FOR CONSULTATIONS WITH QUALIFIED HEALTH PROFESSIONALS WHO ARE FAMILIAR WITH YOUR INDIVIDUAL MEDICAL NEEDS. WE DO NOT WARRANT OR GUARANTEE THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS OR USEFULNESS OF ANY INFORMATION, PRODUCTS, SERVICES, MERCHANDISE OR OTHER MATERIAL PROVIDED BY USING MYCOMMONSPIRIT - MOUNTAIN GENERALLY. WE DISCLAIM AND ALL MAKE NO WARRANTY OR GUARANTEE THAT MYCOMMONSPIRIT - MOUNTAIN WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

Modifications and Updates

CommonSpirit Health reserves the right to modify, amend and update these Terms of Use at any time by posting amended Terms of Use on MyCommonSpirit - Mountain. Any updates to these Terms and Conditions of Use will be posted on MyCommonSpirit - Mountain, from time to time. You acknowledge and agree that it is your responsibility to review these Terms of Use from time to time and to be aware of any such changes. Your use of MyCommonSpirit - Mountain after such posting constitutes acceptance by you of the revised Terms of Use.

Proprietary Rights

The materials on MyCommonSpirit - Mountain are copyrighted by MyCommonSpirit - Mountain and/or other applicable rights holders. You acknowledge and agree that MyCommonSpirit - Mountain and any necessary software used in connection with MyCommonSpirit - Mountain contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that any content contained in sponsor advertisem*nts or information presented to you through MyCommonSpirit - Mountain or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

Indemnity

You agree to release, indemnify and hold CommonSpirit Health, and our directors, officers, physicians, employees, agents and third party licensors harmless from and against any and all liabilities, losses, damages, claims, and expenses, including reasonable attorneys' fees, with respect to (a) any and all injury, disability, death or damage to property (tangible or intangible) arising from or relating to your use of MyCommonSpirit - Mountain; (b) any infringement or violation of any intellectual property rights arising from or relating to your use of MyCommonSpirit - Mountain (including any content); (c) any breach of your representations or obligations under this Agreement; and (d) any activity that occurs under your User ID and password.

MyCommonSpirit - Mountain Use Rights and Restrictions

Subject to the terms and conditions outlined in this Agreement, CommonSpirit Health grants to you a personal, revocable, non-assignable, non-sublicensable, and non-exclusive limited right to (i) use MyCommonSpirit - Mountain and (ii) view all content provided, made available or otherwise accessible via MyCommonSpirit - Mountain. Except as expressly authorized by CommonSpirit Health or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on MyCommonSpirit - Mountain, in whole or in part. You may download and reprint a single copy of the materials from MyCommonSpirit - Mountain for your own personal, noncommercial use only, provided you include all applicable notices and disclaimers. You agree not to modify MyCommonSpirit - Mountain in any manner or form, or to use modified versions of MyCommonSpirit - Mountain, including (without limitation) for the purpose of obtaining unauthorized access to MyCommonSpirit - Mountain. You agree not to access MyCommonSpirit - Mountain by any means other than through the interface that is provided by CommonSpirit Health for use in accessing MyCommonSpirit - Mountain. You shall not, in whole or in part, adapt, translate, modify, decompile, reverse engineer, or disassemble MyCommonSpirit - Mountain, merge MyCommonSpirit - Mountain into other program material, nor shall you otherwise create or attempt to obtain the source code of MyCommonSpirit - Mountain.

Governing Law and Venue

If services are performed in the State of Colorado, this Agreement shall be governed by and shall be construed in all respects under the laws of the State of Colorado, exclusive of its choice of law or conflict of laws provisions. If services are performed in the State of Kansas, this Agreement shall be governed by and shall construed in all respects under the laws of the State of Kansas, exclusive of its choice of law or conflict of laws provisions.

In all respects, in any claim or action by you directly or indirectly arising under this Agreement or related to your use of MyCommonSpirit - Mountain, you irrevocably agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Arapahoe County, Colorado. You waive any jurisdictional, venue or inconvenient forum objections to such court. If any of the provisions of this Agreement are held to be unenforceable by a court or other tribunal of competent jurisdiction, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

Rights, Remedy, and Termination

CommonSpirit Health may, in its sole discretion, terminate your access to MyCommonSpirit - Mountain, or any portion thereof, or discontinue providing MyCommonSpirit - Mountain, or any portion thereof. CommonSpirit Health may notify you that you have breached this Agreement and your account is being terminated. These actions are in addition to and not in lieu or limitation of any other right or remedy CommonSpirit Health may have available at law. Further, CommonSpirit Health shall not be liable to you or any third party for any such termination or discontinuance.

MyCommonSpirit - Mountain may contain links to websites operated by other parties. CommonSpirit Health does not sponsor, operate, control, or endorse any of these sites, nor the information, products, or services provided by third parties through the Internet, nor does CommonSpirit Health make any guarantee, warranty, or representation regarding the accuracy of the information contained on the websites. CommonSpirit Health has no control over the security or privacy practices of these external websites. Use of other sites is strictly at your own risk. You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of such other websites.

Additional Terms and Conditions for MyCommonSpirit - Mountain Alerts (SMS Messaging Service)

Program Description . MyCommonSpirit - Mountain Alerts allow mobile subscribers to opt-in to receive alerts about their MyCommonSpirit - Mountain account through SMS text messages on their mobile phones.

Cost . There are no premium charges for receiving MyCommonSpirit - Mountain Alerts; however, standard message and data rates may apply.

Supported Carriers . Alltel, Appalachian Wireless, AT&T, Bluegrass Cellular, Boost Mobile, Cellcom, Cellular South, Centennial Wireless, GCI, Immix Wireless, Inland Cellular, IV Cellular, Nex-Tech Wireless, nTelos, Metro PCS, Sprint, T-Mobile, U.S. Cellular, United Wireless, Verizon Wireless, Virgin Mobile USA, and West Central Wireless.

T-Mobile is not liable for delayed or undelivered messages.

Message Frequency . If you opt-in to receive alerts or information from MyCommonSpirit - Mountain, you will receive one SMS message on your mobile phone each time you have a new message in your MyCommonSpirit - Mountain account.

How to Opt-Out of SMS Messaging Service . To opt-out of receiving messages from MyChart, you must log into your MyCommonSpirit - Mountain account, select the Preference tab and deselect the Alert Type under Notification Settings which you do not wish to receive. If you have sent a command in MyCommonSpirit - Mountain to opt-out and have questions about whether it has been processed, please contact CommonSpirit Health using the information in “Support/Help” below.

Privacy Policy . CommonSpirit Health will use your information in compliance with applicable state and federal laws. For more information on how CommonSpirit Health uses your information, please view our complete Notice of Privacy Practices .

Additional Terms and Conditions for E-Visit

IF YOU ARE A RESIDENT OF COLORADO, EACH TIME YOU THE USE E-VISIT SERVICE, YOU UNDERSTAND AND AGREE THAT YOU MUST BE PHYSICALLY LOCATED IN THE STATE OF COLORADO, AND YOU ACKNOWLEDGE THAT YOU ARE PRESENTLY LOCATED IN THE STATE OF COLORADO. E-VISIT MAY NOT BE USED IF YOU HAVE MOVED OR RESIDE OUTSIDE THE STATE OF COLORADO.

IF YOU ARE A RESIDENT OF KANSAS, EACH TIME YOU USE THE E-VISIT SERVICE, YOU UNDERSTAND AND AGREE THAT YOU MUST BE PHYSICALLY LOCATED IN THE STATE OF KANSAS, AND YOU ACKNOWLEDGE THAT YOU ARE PRESENTLY LOCATED IN THE STATE OF KANSAS. E-VISIT MAY NOT BE USED IF YOU HAVE MOVED OR RESIDE OUTSIDE THE STATES OF KANSAS.

Use for Non-Urgent Conditions . E-Visits should only be used to request medical care for certain non-urgent conditions. You should not attempt to seek emergency care through E-Visits. If you have an urgent need to seek medical attention, you should contact your provider's office by phone, or for medical emergencies, call 9-1-1.

Consent for Care . You consent to receive medical care from your provider via the E-Visit option. The scope of care will be at the sole discretion of your provider, and you understand that there are limitations to the care that can be provided through E-Visits. You also understand that E-Visits do not take the place of an in-person appointment. You understand that if your provider is unable to treat your concern through an E-Visit, you should come to your provider's office for an in-person visit.

Refusal of Treatment . You understand that if you refuse treatment that is suggested by your health care provider or you do not complete a treatment protocol recommended to you by your health care provider, you will not hold CommonSpirit Health liable for the consequences of your refusal or decision not to complete your recommended treatment.

Location . You understand that you are responsible for ensuring your privacy from others at your location during your E-Visit, and you affirm that you will take precautions to ensure that your E-visit cannot be viewed by others near you without your permission.

Privacy Notice . You understand that the contents of your E-Visit (messages between you and your provider as well as information that you have entered concerning your condition) will become a part of your medical record. You authorize CommonSpirit Health to disclose copies of all or any part of your medical records obtained in the course of your diagnosis and treatment from your E-Visit in accordance with CommonSpirit Health's Notice of Privacy Practices.

Content of Communications . You understand that you are responsible for your communications during your E-Visit. You will not:

 communicate material that is obscene, defamatory, threatening, abusive or hateful

 communicate sexually-explicit images

 impersonate another person

 violate the Children's Online Privacy Protection Act (COPPA)

 communicate material that is copyrighted, without the permission of the copyright holder

 communicate material that infringes on any other intellectual property rights of others or the privacy or publicity rights of others

Additional Terms and Conditions for Apple HealthKit

With your permission, certain versions of our Applications can connect to Apple HealthKit to receive health information and to share that information with your healthcare providers.
Our Applications do not share your health information with HealthKit or with other HealthKit-enabled software.
